Terms & Conditions

By engaging the services of Kapture Media Solutions (hereafter referred to as “Photographer”), you certify that you have read and agree to the following Terms and Conditions.

This Agreement governs the relationship between the parties and in no event shall any e-mail communication or other exchange, amend or otherwise modify the terms of this Agreement unless agreed to in writing.

1.  YOUR PHOTO/VIDEO SHOOT

Your listing will be shot "as-is" meaning the property should be ready to photograph or video on the day of the photo/video shoot. Agents are expected to have the property staged and cleaned prior to the photo/video shoot. Your input is important when choosing the best rooms and angles to photograph or video. Absent your input, the photographer will use his best judgment and experience to decide how best to photograph or video the property. Plan on 2-3 hours per shoot depending on the size of the property.

2.  DELIVERY

All photos and videos will be delivered via Google drive links. You will have the link emailed to your email provided in the booking form in 48 hours or 2 business days after your shoot date. No order should be delivered in more than four consecutive days from your shoot date. Video services need a 72 hour timeframe or 3 business days unless otherwise noted and will be delivered with the same method as the photos. Photographer may select delivery of photographs in JPG, TIFF, PNG, or other standard format, at a resolution that Photographer determines will be suitable for the Photos as licensed. Videos are typically delivered in mp4 format at 4k resolution. It is the Client’s responsibility to notify the photographer if the Photos or Videos are to be delivered at a specific resolution or file format. The Photographer has no obligation to retain or archive any Photos or Videos delivered to Client.

3.  PAYMENT

An invoice will be sent to the email provided in the booking form prior to the start of the scheduled photoshoot. Payment is due at the time of the photoshoot. Only cash, check or credit payment methods are accepted. Credit payments are subject to a 3.5% processing fee. Payment indicates acceptance of and agreement to all Terms and Conditions outlined here. 

4.  IMAGE & VIDEO RIGHTS AND USAGE

All images and videos produced for the agent or broker (client) may be used by the client for any and all marketing materials and campaigns associated with the property and the client's self-promotion. Ownership of the photos and videos remains with me (photographer) and license to use the photos and videos are granted only to the client, and not to any third party. Any usage by any third party including designers, stagers, builders, homeowners, etc. is prohibited without written permission from the photographer.

5. CANCELLATIONS

If cancellation or re-scheduling is necessary, please do so with a minimum of 24 hours notice. Any shoot canceled or re-scheduled within 24 hours of a booked appointment is subject to a $75.00 change/cancellation fee.
